Web Tiles are interactive. Webtiles and Banners are realtime upload Adult, Band, & Classified Ad Rates 1. PAYMENT - Full payment is due prior to publication. Yearly accounts, will be billed in three month increments in advance of publication. All payments are due and payable on or before issue publication date. Payments for Advertising not received within 30 days of the publication date will be assessed an additional $25/month late fee. Sponsorship placed by an Advertising Agency is the responsibility of that agency unless specific written instructions place payment responsibility with the client. Discounts are available if the full term of the contract is paid in advance. For terms and conditions see a program consultant. 2. POSITION - Requests for position shall be treated as such, but ultimate location of Sponsorship Display contracted for shall be at the discretion of the Publisher. Unless at some time something of value was passed along to someone who makes the final decision. 3. SHORT RATE - The Sponsor expressly agrees that if at the end of the period named in his Sponsor Agreement, or upon the prior termination of the Sponsor Agreement for any cause. The Sponsor shall be held liable for any unused portion of his Sponsorship. And the Sponsor shall pay equal to the difference between the price applicable and the amount of Sponsorship actually used according to the schedule of Sponsorship rates. (If you stop running the ad you still have to pay for space reserved. 4. CONDITIONS - The Publisher reserves the right to revise the rate stipulated herein at any time. The Sponsor shall have the right, within 30 days after notification of any such revision, to cancel the contract without short rate penalty charge, at any date upon which new or higher rates are made effective by the Publisher. No additional terms or conditions pertaining to the contract will be recognized by the Publisher except those endorsed in writing and authenticated by the signature of both parties. 5. RATES ESTABLISHED - AS OF 6/02 BASED ON A CIRCULATION OF 50,000 COPIES PER MONTH. 6. EXCLUSIONS - There are no conditions, verbal or otherwise, binding Publisher other than those stated in the contract, and it is accepted solely on that basis. 7. 3. DEADLINES All deadlines falling on Saturday or Sunday will be moved to 5pm the next business day. 4. All Sponsorship agrees to is subject to all federal, state and local laws and may be edited or rejected at the discretion of the Publisher. 5. Editorial copy is FREE. It is a separate entity from paid Sponsorship. The publisher shall not be held responsible for any errors in editorial copy other than to print a retraction in the next issue. 6. All Sponsor displays are accepted and published entirely on the representation that the agency and Sponsor are authorized to publish the entire contents and subject matter thereof. In consideration of the publication of Sponsor Displays, the Sponsor and agency will indemnify and save the Publisher harmless from and against any loss or expense arising out of publication of such Sponsor display, including without limitation, those resulting from claims or suits for libel, violation of right of privacy, plagiarism or copyright infringement. In consideration of the Publisher reviewing for acceptance, or acceptance of, any Sponsorship for publication, the agency and Sponsor agree not to make promotional or merchandising reference to Suburban NiteLife, Dining NiteLife or any or all of its publications, in any way except with the permission of the Publisher for each use. 7. The Publisher shall not be subject to any liability whatever for any failure to circulate all or any part of any issue or issues because of strikes, work stoppages, accidents, fires, acts of God or any other circumstances not within the control of Suburban NiteLife Inc. 8. The Publisher reserves the right to reject or cancel any Sponsorship for any reason at any time. `This however is highly unlikely. 9. The Publisher will not be liable by any reason of any error, for which it may be responsible, beyond liability for cost of the actual space occupied by the item in which the error occurred. In case of typographical errors or omissions, the Publisher shall not be liable beyond the cost of the Sponsor Displays. The Publisher shall be under no liability for failure for any reason to insert an Sponsor Displays. In such event, the Sponsor will, at its option, be entitled to a credit for the price of the ad or insertion of the Sponsor Displays in a future issue of the newspaper or newspapers. Sponsor Displays submitted after the deadline for proof service are submitted at the Sponsor’s own risk, and the Publisher shall assume no liability for errors or omissions in such Sponsor Displays. 10. No conditions, printed or otherwise, appearing on contracts, orders, or copy instructions which conflict with the provisions of the contract will be binding on the Publisher.
